Workshop: The role of free movement of persons agreements in addressing disaster displacement in Africa

The Platform on Disaster Displacement organizes, in partnership with the Development and Rule of Law Programme (DROP) at Stellenbosch University, a workshop on the role of free movement of persons agreements in addressing disaster displacement in Africa. The workshop will take place in Stellenbosch, South Africa on 27-28 November 2019.

In May 2019, the Platform on Disaster Displacement published a report titled: ‘The Role of Free Movement of Persons Agreements in Addressing Disaster Displacement: A Study of Africa’ (PDD Free Movement study). This report considers whether, and how, agreements for the free movement of persons could assist in addressing the protection gap for disaster displaced persons in Africa, including displacement that occurs in the context of sudden- and slow-onset disasters and the adverse effects of climate change. The PDD Free Movement study concludes that ultimately, the extent to which agreements for the free movement of persons could contribute to addressing displacement in the context of disasters and adverse effects of climate change in Africa depends on how they are incorporated and implemented at the national level, where state practice could either reinforce or address the potential limitations. As such, the report recommends that further research is required in order to fully assess the extent to which agreements for the free movement of persons do, or could, address disaster displacement in Africa. It also suggests the development of recommendations for how African States could further develop or supplement existing free movement agreements to maximize the potential benefits for disaster displaced persons.

Following the conclusions of this study, the Platform on Disaster Displacement and the Stellenbosch University are organizing a stakeholder workshop on the role of free movement of persons agreements in addressing disaster displacement in Africa. The key objectives of the stakeholder workshop are:

  1. Explore and evaluate opportunities and limitations that free movement agreements provide for preventing and responding to displacement in the context of disasters and adverse effects of climate change in Africa. Identify and discuss issues that do or could arise in the implementation of free movement agreements.
  1. Identify and evaluate specific strategies or solutions that could enhance the role of free movement agreements in addressing disaster displacement.
  1. Identify key areas where further research and engagement could enhance the role of free movement in addressing disaster displacement. Solicit feedback on the 2019 PDD Free Movement study. Assess and refine the scope and methodology of the follow-up research recommended in the report.

This workshop will bring together policymakers and experts from the Secretariats and Member States of the Intergovernmental Authority on Development (IGAD), the Economic Community of West African States (ECOWAS), and the Southern African Development Community (SADC). Select researchers and resource-persons from relevant UN agencies and other partners will also attend. The workshop is generously funded with contributions from the governments of Switzerland and Germany.

La Plateforme sur les déplacements liés aux catastrophes organise, en partenariat avec le Programme de Développement et Etat de Droit (DROP) de l’Université de Stellenbosch, un atelier au sujet du rôle des accords sur la libre circulation des personnes en réponse aux déplacements liés aux catastrophes en Afrique. Cet atelier aura lieu à l’Université de Stellenbosch en Afrique du Sud, les 27 et 28 novembre 2019.

En mai 2019, la Plateforme sur les déplacements liés aux catastrophes (PDD) a publié un rapport intitulé : <<le Rôle des accords de libre circulation des personnes face aux/à l’égard des déplacements liés aux catastrophes en Afrique>> (ci-après, l’étude de la PDD). Ce rapport examine si, et comment, les accords de libre circulation des personnes pourraient contribuer à combler le déficit de protection pour les personnes déplacées en cas à des catastrophes en Afrique, y compris les déplacements qui surviennent dans le contexte de catastrophes soudaines ou à évolution lente, ou dans le cadre des effets négatifs du changement climatique. L’étude de la PDD conclut que, finalement, la mesure selon laquelle les accords de libre circulation des personnes pourraient faire face aux déplacements liés aux catastrophes ou aux effets négatifs du changement climatique en Afrique dépend de la manière dont ils sont incorporés et mis en place au niveau national, la pratique des Etats pouvant soit renforcer soit remédier aux limitations potentielles. Enfin, le rapport recommande de poursuivre des recherches afin d’évaluer pleinement dans quelle mesure les accords de libre circulation des personnes permettent ou pourraient permettre de faire face aux déplacements liés aux catastrophes en Afrique. Aussi, il suggère d’élaborer des recommandations sur la manière dont les Etats africains pourraient développer ou compléter les accords existants de la libre circulation des personnes afin de maximiser les avantages potentiels pour les personnes déplacées liés aux catastrophes.

A la suite des conclusions de cette étude, la PDD et l’Université de Stellenbosch organisent un atelier des parties prenantes au sujet du rôle des accords de libre circulation des personnes face aux/à l’égard des déplacements liés aux catastrophes en Afrique. Les principaux objectifs de l’atelier sont :

  1. explorer et évaluer les opportunités et les limitations qu’apportent les accords de libre circulation des personnes, dans la prévention et la réponse aux déplacements dans le contexte de catastrophes ou des effets négatifs du changement climatique en Afrique. Les participants discuteront ces opportunités et limitations dans le cadre des communautés économiques régionales de la CEDEAO, de l’IGAD et de la CDAA plus particulièrement. Ils identifieront et discuteront aussi des problèmes qui existent ou qui pourraient se produire dans la mise en œuvre des accords de libre circulation des personnes à échelle nationale ;
  2. identifier et évaluer des stratégies ou solutions spécifiques qui pourraient améliorer le rôle des accords de libre circulation des personnesface aux/à l’égard des déplacements liés aux catastrophes ; et,
  3. identifier des domaines clésoù des recherches et un engagement plus poussés pourraient améliorer le rôle des accords de libre circulation des personnes face aux/à l’égard des déplacements liés aux catastrophes. Cela serait aussi l’occasion de discuter et de commenter l’étude de la PDD.

Cet atelier réunira des responsables politiques et des experts des Secrétariats et Etats membres de l’Autorité Intergouvernementale pour le Développement (IGAD), la Communauté économique des États de l’Afrique de l’Ouest (CEDEAO), et la Communauté de développement d’Afrique australe (CDAA). Des chercheurs et des experts choisis parmi les agences des Nations Unies concernées et d’autres partenaires participeront également. L’atelier est généreusement financé par les contributions des gouvernements de la Suisse et de l’Allemagne.
